NPL investing in Catalonia: data and legal risks 2026
Investing in NPLs in Catalonia means weighing two things at once: a high volume of foreclosures, and a Catalan housing framework that adds steps and timelines not found in other regions. An NPL is a defaulted loan bought at a discount; in Catalonia, legal analysis matters as much as price.

Trends: what is happening worldwide and in Spain
- Spain, September 2026. INE, Spain’s statistics office, published provisional second-quarter data on 16 September: 7,141 mortgage foreclosure certificates registered, 12.2% more than a year earlier. Catalonia ranked second with 1,355 properties, behind Andalusia (1,674). Source: INE, Mortgage Foreclosure Statistics, Q2 2026.
- Spain, October 2026. The General Council of the Judiciary (CGPJ) released its second-quarter figures on 16 October: 6,886 mortgage foreclosures filed in Spain, 28.6% fewer than a year earlier, and 2,270 in Catalonia, or 32.9% of the total. The figures come from Law&Trends, citing the EFE news agency.
- Worldwide, October 2026. KBRA DLD estimates that US direct lending volume fell to USD 38.9 billion in the third quarter, the lowest since the second quarter of 2023, while spreads remain wide. Source: KBRA DLD, Monthly Insights & Outlook, October 2026.
What this means for a private investor in Spain: there is a steady flow of proceedings in Catalonia, but INE and the CGPJ measure different things and should not be added together or compared carelessly. INE counts land-registry entries of certificates; the CGPJ counts cases filed in court. More or fewer foreclosures says nothing about what a given asset is worth or how long recovery will take. Globally, with lower volumes and wide spreads, private credit is entering a phase where each deal is examined more closely.
Why Catalonia is different for an NPL investor
Catalonia accounts for about one in three mortgage foreclosure cases in Spain, according to the CGPJ. That means a lot of court activity and a lot of local operator experience. But the region has its own housing legislation, which has changed several times and has been challenged before the Constitutional Court.

The Catalan legal framework: social rent and large holders
According to Cuatrecasas’ analysis of Catalonia’s Law 1/2022 (8 March 2022), the law restored and extended measures from Decree-Law 17/2019 that the Constitutional Court had partly annulled (Ruling 16/2021). Its main points are:
- The concept of large holder extends to legal entities and groups of companies owning more than 10 homes.
- A large holder must offer a social rent proposal to people at risk of housing exclusion before filing eviction claims and enforcement actions arising from mortgage claims, in the cases the law sets out.
- If the large holder is an investment fund, an asset management entity, a venture capital fund or a securitisation fund, the obligation can extend to occupants without legal title, but only if several requirements are met.
- A register of large holders was created, with offences for failing to report data or to make the proposal when it is mandatory.
Source: Cuatrecasas, Legal Flash, March 2022. This analysis is more than three years old: housing rules have been amended since and must always be checked against the current text. We also found no reliable source clarifying whether the buyer of a loan (the assignee) becomes subject to these obligations. A lawyer should answer that before you invest.

Foreclosure data for Catalonia, in one table
| Indicator | Spain | Catalonia |
|---|---|---|
| Foreclosure certificates registered (INE, properties) | 7,141 | 1,355 |
| Of which homes (INE) | 4,989 | 1,079 |
| Mortgage foreclosures filed (CGPJ) | 6,886 | 2,270 |
| Catalonia’s share of the total (CGPJ) | 100% | 32.9% |
The two statistics differ because they measure different stages of the process on different criteria. Use them to see the order of magnitude, not to draw conclusions about the price of a specific asset.
What to analyse before investing in an NPL in Catalonia
- Condition of the property. Whether it is occupied, under what title and since when.
- Debtor profile and procedure. Procedural stage, prior charges and possible negotiated routes.
- Applicable housing rules. Whether a social rent proposal is mandatory and how it affects the timetable.
- Value of the collateral. A current, prudent valuation, discounted for costs and time.
- Exit strategy. Sale, assignment of the foreclosure bid or adjudication.
Risks to consider
- Legal and timing risk. Additional housing requirements can lengthen the procedure.
- Occupancy risk. Recovering possession can take longer and cost more than expected.
- Illiquidity risk. An NPL cannot be sold overnight and recovery time is uncertain.
- Valuation risk. If the property is worth less than expected, part or all of the capital can be lost.
- Regulatory risk. Catalan rules have changed several times and may change again.
Real estate collateral mitigates risk but does not eliminate it.

Frequently asked questions
Can you invest in NPLs in Catalonia?
Yes, but it requires specific legal analysis because of Catalan housing rules, and the ability to accept long timelines and possible losses.
What is a large holder in Catalonia?
According to Cuatrecasas’ 2022 analysis, it includes legal entities and groups of companies with more than 10 homes, as well as financial institutions, funds and other entities. Check the current definition.
What is a social rent proposal?
It is an offer a large holder must make, in certain cases, to people at risk of housing exclusion before suing. It can affect the timetable of a procedure.
Why do INE and CGPJ figures differ?
INE counts certificates registered in the land registry; the CGPJ counts cases filed in court.
Can you lose money investing in NPLs?
Yes. If the property is worth less, there are charges or occupancy, or the procedure drags on, part or all of the capital can be lost.
In summary
- Catalonia accounts for a third of mortgage foreclosures filed in Spain in the second quarter of 2026, according to the CGPJ.

- Catalan housing law adds obligations for large holders and must be checked in its current version.
- Analysis of the property, occupancy and exit strategy matters as much as the purchase discount.
- There is a risk of capital loss, illiquidity and legal delays.
